A federal judge has ruled that California’s death penalty system is so broken it is unconstitutional. The ruling is a huge blow to death penalty advocates. U.S. District Judge Cormac J. Carney said in his order that delays of two decades or more in resolving appeals and carrying out only a few executions have created an arbitrary and irrational system. He said it violates the Constitution’s 8th amendment, which bans cruel and unusual punishment. The last time California’s death penalty was struck down was in 1972, when the state supreme court ruled that it violated the state’s constitution. But voters overturned that ruling later that year on a ballot initiative.
“The people of this state have spoken time and time again on this issue. And I believe the people’s voice should be heard,” Marty Halloran, president of the San Francisco Police Officers Association, said.
