In Ventura, California recently, a judge has ordered an initiative that would phase out the county pension system off the November ballot. Ventura County Superior Court Judge Kent Kellegrew found the measure proposed by leaders of the Ventura County Taxpayers Association could not legally be used to withdraw from a statewide retirement system the county joined in the mid-1940s. Kellegrew agreed with the position of Citizens for Retirement Security, a labor-backed coalition that sued over the measure and requested the court order. “Reduced to its most basic components, this case involves the question of whether or not a county, through the initiative process, may withdraw from a statewide system enacted by the Legislature,” Kellegrew wrote in a final decision. “This court concludes that the initiative process cannot be used for such a process.”
