Association calls foul on civilian investigation
Portland’s police union president, in a message to union members, slammed the city’s effort to allow for independent investigations into alleged officer misconduct by an arm of the city auditor’s office – the Independent Police Review Division. Officer Daryl Turner contends the civilian investigators in the division are “trampling on” his union members’ rights and performing “biased, inadequate and flawed” investigations.
Turner says, ” From the beginning, IPR pursued its desire for “meaningful” investigations at the expense of our members’ rights. It was only after vigorous objections by the PPA that IPR recognized our members’ constitutional rights under Garrity, which instructs that only the Police Bureau can compel our members to IPR investigations; IPR has no such power to compel. Begrudgingly, IPR watered down its desired City Code changes, resulting in a convoluted system where IAD officials compel our members to IPR investigations. No matter for IPR; it got its headline—the ability to perform “meaningful” investigations. IPR is once again trampling on our members’ rights, this time by performing biased, inadequate and flawed investigations. Due process requires a full and fair investigation. But that’s not what we’re getting with IPR.”
